1. Introduction.  

When you use WasteWiser™ (herein referred to as “WW”), you trust us with your data and we’re committed to keeping that trust. That trust starts with helping you understand our privacy practices. This notice describes the data we collect, how it’s used and shared, and your choices regarding this data.

2. Overview.  

2.1 Our Rights and Responsibilities.  

We will provide you access to these Rights and Responsibilities and any subsequent updates.

We encourage you to periodically review this Privacy Policy to learn more about our information practices as they change over time. We reserve the right to update this Privacy Policy periodically, without notice. A change in the effective date will indicate that the Privacy Policy has been updated. Any changes to our Privacy Policy will become effective upon posting of the revised Privacy Policy on our Site(s). Your use of our Site(s), and any of our products and services following such changes constitutes your acceptance of the revised Privacy Policy then in effect. 

We rely on the following legal grounds to process your Data.

In the performance of our services and provision of equipment under our contract(s), we may need to collect and process your Data as necessary to perform services subject to a contractual agreement with you. Examples of our legal grounds to process your  Data as being necessary for the performance of a contract include, but are not limited to: (a) when you make an online purchase in order for the purpose of allowing us to deliver products necessary to perform services under your subscription; and (b) when you register and subscribe to services using WW's website you will be entering into an agreement by and between you, WW, and its affiliates for the purpose of permitting us to collect, use, transfer, process and store your  Data consistent with this Privacy Policy.

Where we ask you for your consent, we will collect and use your Data only to the extent you have consented. We may use your Data for our legitimate interests for the purposes of improving our products and services and improving the content of our Site(s) and improving our applications and systems and for the legitimate interest of our affiliates, subscribers, contractors, and/or other affiliated parties.

WW and its subcontractors will at all times protect your Data with operational, administrative, technical, and physical security safeguards. We do not disclose your Data to third parties unless otherwise stated herein. 

Depending on the Services, we may collect and/or disclose to third parties the following categories of data in order to manage day to day business needs including, but not limited to, providing you with our services, performing services on behalf of a business, payment processing and financial account management, business planning and forecasting, system improvements, security and fraud prevention, testing of new business ideas, and compliance with legal and regulatory obligations: a) Identifiers such as a real name, address, unique personal identifiers, or email address; b) Customer records such as signature; c) Characteristics of protected classifications under California or federal law; d) Commercial information, such as products or services purchased, obtained, or considered; e) Biometric information (any disclosure of biometric information is limited to the purposes described in the Data Use section below); f) Internet or other electronic network activity information such as information regarding a consumer's interaction with an Internet Web site, application, or advertisement; g) Geolocation data; h) Monitory data, such as audio, electronic, visual, or similar information; i) Professional or employment-related information; j) Education information; k) Inferences about preferences, characteristics, psychological trends, preferences, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

2.2 Scope.  

WW respects your privacy and has adopted this Privacy Notice and Cookies Policy for WW as described below (hereinafter “Privacy Policy”).  This Privacy policy is global in nature and describes our data collection automatically in the operation of our website(s), web pages, and emails that link to any WW provider (including third-party providers).  In addition, this privacy policy describes your rights and responsibilities, our rights and responsibilities, how we use the information we collect or retrieve, with whom we share the information, the measures we take to protect the security of data from loss, misuse, and unauthorized access, the choices you make about providing your information/data to us, and how you can contact us. The rights and responsibilities described in our privacy policy do not cover third-party websites that may be linked to our site(s) or referred to on our site(s). These third-party websites have their own privacy policies and we encourage you to read and review them.

This notice describes how WW and its affiliates, subsidiaries, partners, and/or subscribers collect and use data. This notice applies to all users of our apps, websites, features, or other services anywhere in the world unless covered by a separate privacy notice. This notice specifically applies to: a) Monitor Subscribers and Users: individuals, organizations, and/or companies that request or receive collections information, reporting, notices and/or communications related to waste services accountability; b) Information Subscriber Users: organizations and/or companies who provide, subscribe, and/or submit applications and/or information to WW to provide collection services to WW subscribers for collection and/or reporting services; c) Collection Services Provider Users: organizations and/or companies who provide or submit applications to WW to provide collections services and/or equipment and/or pricing information for Monitor Users and/or Information Subscribers and/or Service Subscribers services.

This notice also governs WW’s other collections of data in connection with WW’s services. For example, we may collect the contact information of individuals who use accounts owned by WW for Business customers or of owners or employees of WW service providers, or we may collect other data in connection with our mapping, pricing, servicing records technology, and features. All those subject to this notice are referred to as “users” in this notice. 

In addition, please note the following: WW complies with U.S.  data retention laws.  To learn more about the U.S. Privacy Shield, you may go to https://privacyshield.gov.

Our data practices are subject to applicable laws in the places in which we operate. This means that we engage in the practices described in this notice only if permitted under the laws of those places. Please contact us at info@WasteWiser.com or through the addresses below with any questions regarding our practices in a particular country or region, and put “PRIVACY” in the subject line.

2.3 Data.

For the purposes of this privacy policy, “ Data” is any information that can be used to identify you or, that when added with other data, can be linked to you and includes, but is not limited to personal contact detail: name, street address, email address, telephone number, fax number, credit/debit card information, company, title, language, date of birth, social security number, employment data, education data, financing data, state or federal identification numbers, FEIN, race/ethnic data, residence and/or country of origin data, geolocation coordinates.  

Before we collect any data from you, we will obtain your consent.  You are never required to provide us with your data. If you do not agree to this privacy policy, please do not provide, transmit or allow anyone else to provide or transmit your data to us. If you decide not to provide us your personal data it may affect our ability to allow you to register, subscribe, or otherwise utilize the services of WW. You agree that we may collect, dispose of, receive, use, process, disclose, transfer, analyze, pair, parse, and/or retain your data.  This privacy policy governs your use of any and all of our site(s) and services, and in purchasing our products and services in general.  We will use your data only for the purposes set forth herein.

This notice applies to users of WasteWiser’s services anywhere in the world, including users of WasteWiser’s apps, websites, monitors, features, or other services.

As the subject of the Data collected, you have rights related to the Data that we hold about you and at any time you have the right to: Request access to the information we hold, use, or disclose about you; Ask us to correct or how to correct any inaccurate or incomplete information we have about you or request us to make the corrections; Request us to delete your information from our records, subject to WW’s approval subsequent to prior enrollment; Withdraw consents you have given, where our collection and use based upon your consent. 

You may ask us to send a copy of your Data to a third party in a data portable format, subject to the approval of WW. You may request access, correction, or deletion of the Data you have submitted by contacting WW, by logging into your account, or on our website at WasteWiser.com.

Upon receiving your request, we may need additional information from you to verify your identity and to better understand what it is you are requesting. In this case, we may ask you to provide additional information, including information you have previously disclosed to us, to confirm your identity. If you wish to designate an authorized agent under any applicable law, please contact us by any means listed above and we will coordinate that designation. We will respond to access requests within a reasonable amount of time in accordance with state and national laws and requirements. We recognize that you may have a right to not receive discriminatory treatment by exercising any of the rights listed above. We will not charge a fee to respond to a request unless it is excessive, repetitive, or unfounded. If a fee will apply, we will advise the requester before completing the request, explain why a fee applies, and provide an estimate of the fee.

2.4 Data Controller and Transfer.

WW is the data controller for all data collected in connection with the use of WW’s services. We process data inside and outside of the United States. The data of users outside the United States is transferred on the basis of mechanisms approved under applicable laws.

3.  Data Collections.

3.1 The Data we collect is: a) Data provided by Users to WW, such as during account creation and monitor provisioning; b) Data created during use of our services, such as location, app usage, device data, usage data, and collection data; c) Data from other sources, such as partners and third parties that use WW APIs, LinkedIn, or other outside sources.

3.2 Data provided by Users which includes the following data collected by or on behalf of WasteWiser: a) User Profile: We collect data when users create or update their WW accounts and/or monitor provisioning. This may include their name, email, phone number, login name and password, address, profile pictures, payment or banking information (including related payment verification information), government identification documents, service information, container information, location information, images, and photos. We may use photos submitted to verify any/all related service information for Users and other information to perform information matching and processing; b) Service Data: We collect service data about users, including through user surveys; we may also receive service data about users, subscribers, and/or suppliers from third parties; c) User content: We collect the information users submit when they contact WW customer support, provide ratings or comments for other users or service providers or the public, or otherwise contact WW. This may include feedback, photographs, or other recordings collected by users; 

3.3 Data created during use of our services includes.

a) Location data: We collect precise or approximate location data from a user’s mobile device if enabled by the user to do so. For service drivers and service Providers, WW collects this data when the WW app is running in the foreground (app open and on-screen) or background (app open but not on-screen) of their mobile device and may also collect this data when the WW app is running in the background of the user’s mobile device. Service Users, Service Providers, Partners, and Subscribers may use the WW apps without enabling WW to collect location data from their mobile devices. However, this will affect the functionality available in the WW system(s). For example, a user who has not enabled location data collection will have to manually enter their address, which may not permit optimal service accountability. In addition, the location data collected from a User, Service Provider, or driver will be linked to the applicable account(s), even if they have not enabled location data to be collected from their device, including for purposes of receipt generation, customer support, fraud detection, insurance, and/or litigation; b) Transaction information: We collect transaction information related to the use of our services, including but not limited to the type of services requested or provided, order details, delivery information, date and time the service was provided, amount charged, services provided, and payment method. Additionally, if someone uses your Wise Rewards code, we may associate your name with that person and/or others withing that ‘branch’ of data information; c) Usage data: We collect data about how users interact with our services and their collection systems. This includes data such as access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and third-party sites or services used before interacting with our services. In some cases, we collect this data through cookies, pixels, tags, and similar tracking technologies that create and maintain unique identifiers. To learn more about these technologies, please see the third-party websites and section 3.4 of this privacy notice; d) Device data: We may collect data about the devices used to access our services, including the hardware models, device IP address, operating systems and versions, software, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion data, and mobile network data; e) Communications data: We enable users to communicate with each other and WW through WW’s mobile apps and websites. For example, we enable Service Providers, Subscribers, and Data Users to call, text, or send other files to each other (generally without disclosing their telephone numbers to each other). To provide this service, WW receives some data regarding the calls, texts, or other communications, including the date and time of the communications and the content of the communications. WW may also use this data for customer support services (including to resolve disputes between users), for safety and security purposes, to improve our products and services, and for analytics; f) Monitor and device data: We collect data generated by monitors and submission devices including the date and time of use, and the location, route, and distance traveled. To the extent permitted by law, the location data collected from these devices will be linked to the Subscriber’s account, even if they have not enabled WW to collect location data from their mobile device; 

3.4 Data from other sources, including not limited to.

a) Third-Party Websites and social media: We may also collect information via third-party websites such as Google, LinkedIn, or via social media such as, but not limited to, Twitter and Facebook. This information may include your name, address, username, email address, website visited, content posted, IP address, nationality, language, and other publicly available demographics. This information is used to improve the products and services that we offer, to identify and resolve customer service issues, and to provide the information and services you request; b) Internet Service Providers: This Site receives information that is automatically generated by a user's Internet service provider (ISP), browser or mobile device. This information may include the IP address, the associated URLs, domain names, the browser type, the approximate location of the ISP's servers, the pages of our Site that the user views, and any search terms entered on this Site. This information may be collected for system administration purposes, to gather broad demographic information and to monitor the level of activity on the Site. We reserve the right to link this information to your Data in order to protect the integrity of our system and for security purposes. The Internet is a global environment. By using this Site and sending information and Data to us electronically, you consent to trans-border and international transmission of any data that you may choose to supply us to any country in the world, including countries without an adequate level of data protection. Information and Data transmissions to this Site and emails sent to us may not be secure. Given the inherent operation and nature of the Internet, all Internet transmissions are done at the user's own risk; c) In house, client, referral, vendors, and additional third-party providers from which we may also collect information including but not limited to: User feedback, such as ratings, feedback, or compliments and/or users participating in our referral programs. For example, when a user refers another person, we receive the referred person’s  data from that user; WW account owners who request services for or on behalf of other users, or who enable such users to request or receive services through their accounts, this includes WW for Business accounts; users or others providing information in connection with claims or disputes; WW business partners through which users create or access their WW accounts, such as payment providers, social media services, or apps or websites that use WW’s APIs or whose APIs WW uses; Vendors who help us verify users’ identity, background information, and eligibility to work, for regulatory, safety, and security purposes; Insurance, vehicle, or financial services providers for service Providers; Provider transportation companies (for drivers or service Providers who use our services through an account associated with such a company); Publicly available sources; and/or Marketing service providers; 

4. Data uses.

4.1 How WasteWiser uses data it collects.

WW collects, uses, and may combine data from various sources with other data in its possession to enable reliable and convenient reporting, service delivery, accuracy and other product(s) and services enhancements and quality improvement and/or testing. WW does not sell or share data with third-parties for their direct marketing, except with users’ consent. We also use collected data: to enhance the safety and security of our subscribers, providers, and services; for subscriber support; for research and development; to enable communications between users, WW, providers, and related parties; to send marketing and non-marketing communications to users; or in connection with legal proceedings.

4.2 Providing services and features.

WW uses the data we collect to provide, personalize, maintain, and improve our products and services. This includes using the data to: create and update users’ accounts; Verify user identity, and background history; monitor services; offer, process, or facilitate payments for our services; offer, obtain, provide, or facilitate invoicing, or financing solutions in connection with our services; track and share the progress of WW services; enable features that allow users to share information with other people, such as when subscribers submit a commment about a service, or provide feedback for a service Provider, refer a friend to WW; enable features to personalize users’ WW accounts, such as creating bookmarks for favorite places, and to enable quick access to previous destinations; enable features that make it easier for users with disabilities to use our services, such as those that enable text messages from subscribers, and enable receipt of flashing notifications instead of sound notifications on their mobile device; perform internal operations necessary to provide our services, including to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends.

4.3 Safety and security.

We use data to help maintain the safety, security, and integrity of our services and users. This includes: using data from devices to help identify unsafe behavior; using device, location, profile, usage, and other data to prevent, detect, and combat fraud or unsafe activities.

4.4 Customer support.

WW uses the information we collect (including recordings of customer support calls with notice to and the consent of the user) to provide customer support, including to: direct questions to the appropriate customer support person; investigate and address user concerns; monitor and improve our customer support responses and processes; 

4.5 Research and development.

We may use the data we collect for testing, research, analysis, product development, and machine learning to improve the user experience. This helps us to improve and enhance the safety and security of our services, improve our ability to prevent the use of our services for illegal or improper purposes, develop new features and products, and facilitate solutions in connection with our services.

4.6 General disclosure.

We may disclose Data in the following situations: (a) in response to a subpoena, court order or legal process, to the extent permitted and required by law; (b) to protect your security, or the security of other persons, consistent with applicable law; (c) to address actual or suspected fraud or other illegal activities; (d) in connection with a sale, joint venture or other transfer of some or all of the assets of WW, Inc.; (e) where you explicitly agree to follow the WW group to disclose your Data to select third parties; and (f) to our subcontractors and/or agents (such as, those third parties hosting one or more of our website's; processing credit card transactions and payments; fulfilling and processing orders; assisting us with marketing and promotions; collecting web analytics data, etc.), including independent contractors solely for the purpose of enabling them to perform services on our behalf. WW has / will have agreements in place with its third-party subcontractors and/or agents prior to the transfer of any Data requiring that such subcontractors and/or agents; (g) only use the Data for purposes identified by WW; (h) protect the Data in a manner that is consistent with this Privacy Policy and the Principles as set forth in EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework; and (i) notify WW if such subcontractor and/or agent makes a determination that it can no longer meet its obligation to provide the same level of protection as is required by the Privacy Notice. In cases of onward transfers, WW complies with the Privacy Shield Principles for onward transfers of Data from the EU, EEA and Switzerland, including the onward transfer liability provisions. We do not provide your Data to any third parties who are not connected with the services we provide or relate to such products or services unless you agree. Except as disclosed in this Privacy Policy, we will not provide your Data to third parties

4.7 Aggregation of Non-Person Specific Data.

We may statistically aggregate in non-person-specific form, data gathered and other information collected in the use of WW services by end-users and transfer this information to other independent providers at WW discretion. Such aggregated non-person-specific information may be used for quality control, operations management, security, and marketing purposes and to enhance, develop, or improve certification, credentialing, licensure, and testing processes, and related products and services. By subscribing to WW services, you give to us your consent to this non-person-specific data aggregation and the use and transmission of this aggregated statistical data as outlined herein.

5. Cookies and third-party technologies.

WW and its partners use cookies and other identification technologies on our apps, websites, emails, and online ads for purposes described in this notice.

5.1 What are Cookies and third-party technologies.

Cookies are small text files that a web server places on your computer or mobile device. Cookies contain information that can later be read by the web server that originally placed the cookie on your computer or mobile device. Below is a list of the main types of cookies we use and what we use them for:

Strictly Necessary Cookies: These cookies are essential in order to enable you to move around the Site and use its features, such as accessing secure areas of this Site. Without these cookies, services you have asked for, like shopping baskets or e-billing, cannot be provided.

Performance Cookies: These cookies collect information about how visitors use a website, for instance which pages visitors go to most often, and if they get error messages from web pages. Some of the performance cookies are analytics cookies using third party web analytics software, which allow us to understand more about how our Site is used. 5.2 How to manage cookies.

If you block cookies or cookies are not enabled on your computer, it will mean that your browsing or shopping experience on our websites will be limited. Some active content and online shopping baskets, for example, may not work correctly. 

5.3 Other Third-Party Technologies.

Web Beacons are small strings of code that provide a method for delivering a graphic image on a web page for the purpose of transferring data. For example, when you visit a page on this Site, the code for the page being visited may be transferred to us. The information transmitted to us is only used internally by us and is not shared with any third parties, except as provided in this Privacy Policy. We use this information for the following purposes: to allow us to better understand the traffic patterns within our websites and, subsequently, to adjust our content to better respond to our visitors’ interests; and to obtain and to suggest materials and resources that may be of interest to you based on your use of our Site. This Site does not respond to web browser "do not track" signals, comparable signals, or mechanisms.

5.4 WasteWiser Uses.

WW uses cookies and similar technologies for purposes such as: authenticating users; remembering user preferences and settings; determining the popularity of content; delivering and measuring the effectiveness of advertising campaigns; analyzing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with our services. 

We may also allow others to provide audience measurement and analytics services for us, to serve advertisements on our behalf across the Internet, and to track and report on the performance of those advertisements. These entities may use cookies, web beacons, SDKs, and other technologies to identify the devices used by visitors to our websites, as well as when they visit other online sites and services.

We may, for example, collect information about the type of device you use to access the Site(s), the operating system and version, your IP address, your general geographic location as indicated by your IP address, your browser type, the content you view and features you access on the Site(s), the web pages you view immediately before and after you access the Sites(s), whether and how you interact with content available on the Site(s), and the search terms you enter on the Site(s). By using our Site(s), you agree to our use of the cookies as described herein and to our use of web beacons for the collection of information in order to provide the products or services you have requested and for improvements, as we deem appropriate for our legitimate purposes, related to our products and services.

5.5 Data sharing and disclosure.

Some of WasteWiser’s products, services, and features require that we share data with other users or at a user’s request. We may also share data with our affiliates, subsidiaries, vendors, referral agents, and partners, for legal reasons or in connection with claims or disputes. WW may share the data we collect as set forth in this Privacy Notice, including sharing with other users, at the users’ request, with the general public, and with WW account owners, subsidiaries, affiliates, business partners, and for legal reasons.

6. Data Retention and deletion.

WW retains user profile, transaction, and other data for as long as a user maintains their WW account and may retain certain user data after receiving an account deletion request if necessary, such as to comply with legal requirements. We retain user profile, transaction, and other information for as long as a user maintains their WW account and may also retain certain information, if necessary, for purposes of safety, security, and fraud prevention. For example, if WW deactivates a user’s account for specified reasons adverse to WW, WW may retain certain information about that account to prevent that user from opening a new WW account in the future.

7. Privacy settings.

Settings menus in the WW app for subscribers give them the ability to set or update their location-sharing preferences and their preferences for receiving mobile notifications from WW. Information about these settings, how to set or change these settings, and the effect of turning off these settings can be found at WasteWiser.com.

8. Device permissions.

Most mobile device platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without the device owner’s permission, and these platforms have different methods for how that permission can be obtained. iOS devices notify users the first time the WW app requests permission to access certain types of data and gives users the option to grant or refuse permission. Android devices notify users of the permissions that the WW app seeks before their first use of the app, and use of the app constitutes a grant of such permission.

9. Updates to Privacy Policy.

We reserve the right to update the terms of this Privacy Policy from time to time. We encourage you to visit and review this Privacy Policy periodically to ensure you agree with any changes or updates. We will post our revised privacy notice on our website and update the 'Revision Date' to reflect the date of the changes. By continuing to use our website after we post any such changes or updates you accept the privacy notice as modified.
